What Is the Toxic Substances Control Act?

 

The Toxic Substances Control Act (TSCA) is the primary federal law governing how chemical substances are manufactured, imported, processed, used, and disposed of in the United States. Signed into law in 1976 by President Gerald Ford and significantly overhauled in 2016, TSCA grants the U.S. Environmental Protection Agency (EPA) broad authority to evaluate and regulate chemicals that may pose unreasonable risks to human health or the environment. For any business that manufactures, imports, or processes chemical substances, TSCA defines the regulatory landscape, from pre-market notification requirements for new chemicals to sweeping bans on substances like asbestos and PCBs.


Why Congress Created TSCA

The push to regulate toxic substances began in the 1970s, when the President’s Council on Environmental Quality identified a dangerous gap in federal law: no statute comprehensively addressed the thousands of industrial chemicals entering commerce each year. Environmental crises, including PCB contamination in the Hudson River, polybrominated biphenyl poisoning of Michigan livestock, and mounting evidence of chlorofluorocarbon damage to the ozone layer, underscored the urgency.

Congress passed TSCA with strong bipartisan support. The law’s central premise was straightforward: manufacturers bear the responsibility for developing adequate safety data on their chemicals, and EPA holds the authority to restrict substances presenting unreasonable risk. Notably, TSCA exempts certain categories such as pesticides, food, drugs, cosmetics, tobacco, firearms, and nuclear materials, which fall under other federal statutes.


What TSCA Regulates and How It Works

TSCA’s regulatory architecture rests on several core mechanisms. The TSCA Chemical Substance Inventory catalogs more than 86,000 chemical substances currently in U.S. commerce. Any chemical not on this inventory is classified as “new” and triggers pre-market review requirements.

Pre-Manufacture Notifications (PMNs) require manufacturers and importers to notify EPA at least 90 days before producing or importing a new chemical substance. EPA reviews each submission for potential health and environmental risks before allowing the substance to enter commercial activity. Chemical Data Reporting (CDR) obligations under Section 8(a) require manufacturers and importers to report production volumes, uses, and exposure data every four years for chemicals produced above 25,000 pounds annually at a single site.

Significant New Use Rules (SNURs) extend EPA’s reach to existing chemicals by requiring notification before a substance is used in ways that could create new exposure concerns. The EPA can impose restrictions ranging from labeling requirements to outright bans on chemicals found to present unreasonable risk.


The 2016 Lautenberg Act Fixed Critical Weaknesses

For nearly four decades, TSCA was widely regarded as one of the weakest environmental statutes on the books. The roughly 62,000 chemicals already in commerce when TSCA was enacted were grandfathered onto the inventory without any safety testing. A crippling legal standard required EPA to use the “least burdensome” regulatory approach and prove substantial evidence of unreasonable risk before acting. The result was that EPA regulated fewer than five existing chemicals in 40 years.

The Frank R. Lautenberg Chemical Safety for the 21st Century Act, signed by President Obama in 2016, fundamentally restructured the law. EPA must now systematically prioritize and evaluate existing chemicals through a formal process. Risk evaluations use a health-based safety standard that excludes cost considerations, and the law mandates enforceable deadlines for completing evaluations and issuing risk management rules. EPA must also consider risks to potentially exposed or susceptible subpopulations, including children, pregnant women, and workers.


EPA Enforcement and Penalties

The EPA’s Office of Pollution Prevention and Toxics administers TSCA programs, with enforcement spanning new and existing chemical compliance, PCB regulations, asbestos management, and lead-based paint programs. Civil penalties for TSCA violations can reach upwards of $49,772 per violation per day, with each day of noncompliance counted separately. Criminal penalties for knowing or willful violations can include fines up to $50,000 per day and imprisonment.


Recent TSCA Actions Are Reshaping Chemical Regulation

The period from 2024 through early 2026 has been one of the most active in TSCA’s history. In 2024, EPA finalized a historic ban on chrysotile asbestos, the first comprehensive chemical ban under the strengthened post-2016 TSCA authority. In December 2024, EPA issued a final rule prohibiting virtually all uses of trichloroethylene (TCE), a widely used industrial solvent linked to cancer and developmental harm.

On PFAS, EPA finalized a one-time reporting rule requiring manufacturers and importers to disclose data on PFAS substances listed on the TSCA Inventory. A November 2025 proposed revision would narrow the rule’s scope by introducing de minimis thresholds, with a final rule expected by 2026. Congress is also actively debating TSCA fee reauthorization alongside broader structural reforms, making the current regulatory landscape one of the most dynamic in the law’s history.
